I consider

that the limitation need not be a statutory one but a limitation to which effect would be given by administrative practice. I agree that any candidate for appointment to the Bench should be informed that he may be nominated to be Chairman of the Commission.

I am unable to agree with the Chief Justice Designate that it should be open to the Chief Justice to decline after a trial period of one year to nominate a Judge for the Chairmanship, since, if that situation arose, it would take time to make other But I do agree arrangements for the Public Services Commission. that when the work of the Supreme Court consistently demands the full attention of the Chief Justice and three Puisne Judges, then other arrangements will have to be made for the Public Services Commission.

I wish now to proceed with the proposal to increase the establishment by one Puisne Judge and to appoint a Puisne

I shall Judge to be Chairman of the Public Services Commission. be glad to receive your approval by telegram as soon as possible. On the assumption that you will agree I am taking steps to make the necessary provision for the additional post in the draft Estimates for 1951/52, and I would be grateful if immediate steps to fill the vacancy may be taken. For this purpose I enclose Vacancy No H.K. Jud. 1/51 duly completed.

Mr. Megarry is due to leave Hong Kong in the first week of March. Pending the appointment of a successor, Mr. J.R. Jones, M.C., who is a member of the Commission, has agreed It to undertake the Chairmanship for a period of three months. is important therefore that the new appointment should be made, and the officer selected should arrive for duty in this Colony not later than the beginning of June. The appropriate amendments to the Ordinance will be made before his arrival.
